LIVE X AUTO EXCHANGE WEBSITE PRIVACY POLICY

LIVE X Auto Exchange (referred to below as “LIVE X”) is committed to protecting your privacy and keeping your personal information confidential.   While browsing the LIVE X website or using our site to sell or purchase a vehicle, we will collect certain personal information from you  and will use such information in the manners described in this privacy policy (the “Policy”).  By accessing and browsing the LIVE X site, or using the site to sell, select or purchase a vehicle, you agree to the collection and use of your personal information, and to be bound by the terms and provisions of the LIVE X privacy policy as set forth below. The kinds of private information we collect about you or your account are described below. The LIVE X privacy Policy applies whether you are our current or former customer.

Collection of Information from Minors 13 or Under

The LIVE X website was created to assist customers 16 years of age and older with the purchase of automobiles.  LIVE X does not knowingly solicit any personally identifiable information from children under the age of 13. In addition, LIVE X does not knowingly obtain, retain or use information from anyone who indicates that they are under the age of 13. Accordingly, children under the age of 13 may be restricted from participating in certain features and transactions on the LIVE X website.

Privacy Policies of Third Party Sites

The LIVE X site may contain links to other third party websites which are operated by third parties and may be subject to the additional privacy policies of those entities.  Please review the privacy policies separately set forth at each third party site that governs the collection of information through those sites. The organizations controlling those third party sites are responsible for ensuring that they comply with applicable laws, regulations, and rules. If you visit a site that is not part of the LIVE X site, we encourage you to review that site's privacy policy before providing any personally identifiable information.

 

Collection and Use of Private Information

As noted above, LIVE X does not knowingly solicit any personally identifiable information from children under the age of 13.

We may collect the following kinds of private or confidential information (“Private Information”) about you from the following sources:

  • Information you provide on applications, forms, or other correspondence, such as your name address, social security number and income.
  • Information about your transactions with us or others, such as your account balance and payment history.
  • Information we receive from consumer reporting agencies, credit references, employers, insurance companies and insurance agencies, such as your credit history and creditworthiness, and information that we obtain to verify employment history or that insurance coverage is in force.

LIVE X may also from time to time solicit your opinion on products, services and the LIVE X site itself to be able to better serve our customers and to enhance our website and our products.  These surveys are optional, and your decision to participate in a survey will not affect your status as a LIVE X website user.  We may share your survey responses and information with third parties who may be assisting LIVE X in analyzing or interpreting your survey responses and responding to the survey information.

LIVE X also may collect non-personally identifiable information, including traffic statistics regarding page views; other technical information, including IP address and standard web log information; and supplemental information from third parties. LIVE X may also use web beacons and other similar technology to track certain general usage pattern information, such as the web pages people visit on the LIVE X website. LIVE X also may log users' Internet Protocol (IP) addresses (the information that identifies a particular host computer) for the purposes of system administration, providing certain site functionality and content, site tracking and collecting and reporting aggregate usage information. We may combine this and other non-personally identifiable information with the personally identifiable information that we have collected, including to customize a user's on-line experience.

The LIVE X website may use "cookie" technology and users' IP addresses to customize and enhance your online experience on the site.   We may also contract with third parties who may use cookies and collect information on our behalf or provide services such as credit card or credit application processing, promotional services or data management.

A "cookie" is a small data file stored by your web browser on your computer's hard drive. It allows us to recognize your computer (but not specifically who is using it) when you enter our site by associating the identification numbers in the cookie with other customer information you have provided us. That customer information is stored in our database. Cookie technology is a common feature of many web sites and is necessary in order for certain features of our site to function properly or in order to provide an online service to you. You also should be aware that the LIVE X website cannot generally control the use of cookies (or the resulting use of information obtained from cookies) by third parties that host or provide data, content and services for, or advertise on, the LIVE X website. LIVE X uses reputable third party vendors to serve most of the advertisements that you see on the pages of our site. Third party websites that may link to the LIVE X website may use cookies or other technologies to collect information about your activities, which such websites may then use or disclose as described on their website privacy policies. Please review the privacy policies of other websites of which you are a user or member to learn more about those sites’ practices.

Use and Disclosure of Private Information

LIVE X may use your information to provide you with services and information you have requested, for application for loans related to your purchase of a vehicle, or other products you have purchased or services provided by LIVE X, and to resolve disputes, collect fees, and troubleshoot problems. LIVE X also may use your information to respond to specific inquiries made by you; to prevent potentially prohibited or illegal activities, and enforce our Policy; and to customize, measure, and improve our services, content and layout. In addition, LIVE X may use your information and/or supplement your information with other information we obtain to notify you about special offers, products, services, and information that we think may be of interest to you. You can opt-out of receiving commercial e-mail from us at any time by indicating your preference according to the instructions provided within the e-mails received.

We may disclose Private Information (described above) under the following circumstances:

  • To marketing service providers and joint marketing partners. We may disclose all Private Information to companies that perform marketing services for us or to other financial institutions with which we have joint marketing agreements.
  • With non-affiliated third parties. We may disclose all Private Information about you with non-affiliated third parties as permitted by law.
  • To third parties with whom LIVE X has engaged to perform certain services with the operation of certain aspects of the LIVE X website, including to customize, measure, and improve our services, content, and layout. These third party service providers who have access to your personally identifiable information are authorized to use this information only in a manner consistent with this Policy.
  • To sponsors and other business partners that can offer valuable products and services to our users. LIVE X will not disclose your e-mail address to these partners if you have indicated that you do not wish to receive information, special offers or promotions from third parties via e-mail. From time to time, LIVE X may share or provide non-identifiable aggregated information to these partners, and, in addition, LIVE X may provide them with mailing address and other information so that they may extend offers to you.   • Your information also may be provided to an entity that acquires all or any part of LIVE X or its parent entity's assets or in a merger or acquisition, in which case, you will be notified of such transaction on this website and advised of any change in the applicable privacy policy. Further, we may disclose information to law enforcement or other government officials if asked to disclose it by subpoena, court order or other legal process.

 

Protection of Information

We restrict access to your Private Information to our employees and third parties who need to know that information in order to service your account and to provide services to you related to your sale or purchase of a vehicle from the LIVE X Auto Exchange. Additionally, we maintain physical, electronic, and procedural safeguards to protect your Private Information in a manner consistent with industry standards for similar companies. We will review our safeguards from time to time, and strive to maintain them in a manner consistent with federal regulations, if any, that may be in effect from time to time.

It is important to remember that whatever you transmit or disclose online can be collected and used by others or unlawfully intercepted by third parties. No data transmission over the Internet can be guaranteed to be 100% secure. While we strive to use commercially reasonable means to protect your information, we cannot warrant the security of any information you transmit to us.

Any information voluntarily disclosed by users and posted on our site (on message boards, web logs, and/or in chat areas) may be viewed and used by others. If users post personal information that is accessible to the public online, the user does so at his or her own risk. Users accept that they may receive unsolicited messages from other parties in return.

Assistance to Victim of Identity Theft

If you suspect that someone has had unauthorized access to your account with us or access to your personally identifiable information, you should report this crime to your local law enforcement agency and to the Federal Trade Commission (FTC). Ways to Limit Direct Marketing You May Receive from Outside Sources

There are outside agencies and companies that compile mailing lists for purchase by marketers. You may wish to have your name removed from many of these lists by following the procedures outlined below:

Direct Marketing Association and Member Companies
To remove your name and direct mail or telemarketing lists of members of the Direct Marketing Association, send a written request with your name, address, and Social Security Number (if it was included in the mailing you received) to the Direct Marketing Association. The Direct Marketing Association is responsible for notifying its members (i.e., the agencies and companies that compile mailing lists) that you want your name removed from the lists they sell. Your name and address remains in their consumer exclusion files for five years.

Credit Reporting Agencies (Credit Bureaus)
National consumer credit reporting agencies may also sell or share your name and certain other information to various outside companies for marketing purposes. You may direct these agencies not to do so by calling their toll-free telephone number at 1-888-567-8688 (1-888-OPTOUT)

Federal “Do Not Call” Registry
The FTC has implemented a Do Not Call Registry, effective October 1, 2003. To register for the Telemarketing Do Not Call list, visit the FTC’s Web site at www.donotcall.gov.

Choice of Law

If any disputes arise between us regarding your use of the LIVE X website, such disputes shall be resolved according to the laws of the State of Arizona, without regard to its choice-of-law provisions and the federal and state courts of Arizona shall have exclusive jurisdiction over all claims.

Your California Privacy Rights

California Law permits our customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
